Terms and Conditions (GTC)

for the guest accommodation contract/rental contract of the company city-residence-ffo GmbH Frankfurt (Oder), for the Hotel Zur Alten Oder Frankfurt

1. If a hotel room/function room is ordered, promised or made available, a guest accommodation contract/rental contract has been concluded.

2. The contract for a hotel room includes accommodation. The contract for functional rooms only includes the use. The agreed fee is the applicable daily price.

3. The subletting or subletting of function rooms, exhibition or advertising space requires the written approval of the Hotel Zur Alten Oder Frankfurt.

4. The conclusion of the guest accommodation contract/rental contract obliges the contractual partners to fulfill the contract for the entire duration of the contract. The contract cannot be dissolved unilaterally.

5. Option bookings are binding for both contractual partners. The Hotel Zur Alten Oder Frankfurt reserves the right to allocate the reserved hotel rooms/function rooms to someone else after the option booking has expired.

6. If advance payments requested by the Hotel Zur Alten Oder Frankfurt are not made by the requested date, this immediately releases the Hotel Zur Alten Oder Frankfurt from any agreements made.

7. The reserved hotel room is available to the guest on the day of arrival from 2 p.m. until 11 a.m. on the day of departure. A later departure than 11 a.m. requires prior agreement with reception the evening before. Subject to availability, we will be happy to offer you an early check-in or late check-out for a surcharge.

8. Reservations are held until 6 p.m. If you arrive later, we ask for a written guarantee of the hotel room booking. After that, the Hotel Zur Alten Oder Frankfurt reserves the right to rent the room to someone else. If you do not show up, a no-show invoice will become due in accordance with Section 12.

9. Booked function rooms are only available to the contractual partner at the agreed times. Any use beyond this requires prior agreement with the Hotel Zur Alten Oder Frankfurt.

10. The contractual partner has no right to certain hotel rooms/function rooms.

11. If agreed hotel rooms/function rooms are exceptionally unavailable, for whatever reason, the Hotel Zur Alten Oder Frankfurt will endeavor to procure a replacement of equal value.

12. When changing or canceling booked function rooms/package arrangements, the following rates will be charged:
a)
up to 50 days before arrival: no costs
49 to 30 days before arrival: 30% of the agreed services
29 to 14 days before arrival: 50% of the agreed services
13 to 7 days before arrival: 60% of the agreed services
7 to 1 days before arrival: 80% of the agreed services
on the day of arrival: 100% of the agreed services
b)
for individually reserved hotel rooms, 80% of the agreed services will be charged.
c)
from 60 overnight stays per event, the deadlines specified under point 12 a) are extended by 20 days.

13. The guest reserves the right to prove that the Hotel Zur Alten Oder Frankfurt suffered no damage or less damage than the agreed flat rate due to non-use of the services.

14. For all group bookings, the Hotel Zur Alten Oder Frankfurt must receive a list of participants 14 working days before the group's arrival.

15. If the customer is not the organizer at the same time, both are jointly and severally liable.

16. If the Hotel Zur Alten Oder Frankfurt has justified reason to believe that the event threatens to endanger the smooth running of business, the security or the reputation of the hotel or the guests, as well as in the event of force majeure or internal unrest, it can cancel the event cancel; the assertion of any claims for damages against the Hotel Zur Alten Oder Frankfurt is excluded.

17. Newspaper advertisements that contain Hotel Zur Alten Oder Frankfurt data for invitations, sales events and job interviews, or the use of the Hotel Zur Alten Oder Frankfurt name for advertising measures by the contractual partner generally require the prior written consent of the hotel. If publication takes place without the consent of the hotel and this impairs essential interests of the hotel, the Hotel Zur Alten Oder Frankfurt has the right to cancel the event; in this case, payment according to point 12 a to c will be insisted on.

18. In the case of joint meals, the organizer must inform the Hotel Zur Alten Oder Frankfurt of the exact number of participants 3 working days before the start of the event. This number is the guaranteed minimum number and will be billed to the organizer by the Hotel Zur Alten Oder Frankfurt in any case. The Hotel Zur Alten Oder Frankfurt adapts the menu and buffets to the actual number of people without the special consent of the organizer and invoices them accordingly.

19. It is generally not permitted to bring food and drinks with you. Exceptions are only possible in consultation with the Hotel Zur Alten Oder Frankfurt and upon payment of the usual service costs/corkage.

20. The attachment of presentation material or other objects is not permitted without the consent of the Hotel Zur Alten Oder Frankfurt. All decorative material must comply with fire safety requirements.

21. The orderer of function rooms for events is obliged to remove all packaging and/or information material brought in by him at his own expense. If the customer does not meet this obligation, he is obliged to reimburse the Hotel Zur Alten Oder Frankfurt for the disposal costs according to the applicable tariff.

22. The contractual partner is fully liable to the Hotel Zur Alten Oder Frankfurt for damage to the building and inventory caused by himself, his vicarious agents or his guests, unless the contractual partner can prove that the damage was less.

23. As so far as the Hotel Zur Alten Oder Frankfurt arranges external services of a technical, decorative or other type from third parties for the organiser, it acts in the name and for the account of the organiser. The organizer is liable for the careful handling and proper return of these items and indemnifies the Hotel Zur Alten Oder Frankfurt from all third-party claims.

24. Guests paying individually must pay net cash immediately. All guest accounts are payable weekly.

25. Invoices sent on the basis of previous credit agreements are payable within 5 days without deduction.

26. The Hotel Zur Alten Oder Frankfurt accepts the following credit cards:

VISA
However, only for amounts that are not subject to a commission claim or a discounted special price.
The Hotel Zur Alten Oder Frankfurt is entitled to reject credit cards in individual cases. A commission of 10% will be charged on expenses and third-party services when paying by credit card.

27. If the period between the conclusion of the contract and the provision of the service exceeds 180 days, the Hotel Zur Alten Oder Frankfurt reserves the right to make price changes without prior notice.

28. An increase in VAT or the introduction of a beverage tax will be charged to the service recipient, regardless of when the contract was concluded. All prices include the currently valid currency and including service charge and the currently valid VAT.

29. Services from package arrangements that are not used will not be refunded.

30. Malfunctions in the technical or other facilities provided will be rectified immediately as far as possible. However, payments cannot be withheld or reduced. Offsetting against counterclaims is excluded, unless the counterclaims are undisputed or have been legally established.

31. Valuables, money and valuable papers (check and credit cards etc.) are to be deposited in the hotel safe at reception. If these are kept by the guest in the hotel room or in the function rooms or other premises of the hotel, the Hotel Zur Alten Oder Frankfurt assumes no liability for this.

32. The Hotel Zur Alten Oder Frankfurt makes every effort to carry out wake-up calls with the greatest care; However, claims for damages resulting from omission are excluded.

33. Items left behind will only be forwarded freight collect on request. The Hotel Zur Alten Oder Frankfurt undertakes to store it for a period of 6 months.

34. Messages intended for guests, as well as mail and goods consignments are treated with care. The hotel takes care of the storage. delivery and, if requested, the unfree forwarding of the same. However, liability for loss, delay or damage is excluded.

35. The Hotel Zur Alten Oder Frankfurt is also not liable for damages for the vicarious agents of the Hotel Zur Alten Oder Frankfurt, unless the damage is due to an intentional or grossly negligent breach of contract by the legal representative of the Hotel Zur Alten Oder Frankfurt or the vicarious agents.

36. Subsidiary agreements must be in writing.

37. Place of performance and place of jurisdiction is Frankfurt (Oder).

38. The ineffectiveness of individual provisions of the contract or the conditions does not affect the validity of the other provisions. Instead of the invalid provision, a valid provision that comes as close as possible applies.
